What is GetSmart?
GetSmart is a Web site owned and operated by LendingTree, LLC, a Delaware limited liability company (formerly known as LendingTree, Inc.) with its corporate headquarters in Charlotte, North Carolina, and all references herein to LendingTree shall mean LendingTree, LLC, as operator of the GetSmart site. LendingTree is a computerized loan originator. LendingTree is not a lender, auto lessor or credit card issuer. LendingTree does not make loans or credit decisions in connection with loans, nor does LendingTree issue commitments or lock-in agreements. LendingTree is not an agent of either you, the consumer, or any participating bank, lender or loan broker (we refer to all of these as "Lenders"). LendingTree’s services are administrative and consultative only. You should rely on your own judgment in deciding which available loan product best suits your needs and financial means. You are under no obligation to use LendingTree to commence the financing process and LendingTree does not guarantee that completing a loan request will result in your receiving a loan from a Lender. The loan request you submit is NOT an application for credit. Rather, it is a request for a loan pre-qualification. You may have to complete an application with a Lender before they will extend an unconditional loan offer. A Lender you select may require you to pay an application fee to cover the costs of an appraisal, credit report or other items. The Lender will determine the amount of any such fees, and should provide information to you regarding the refund ability of any such fees. LendingTree does not charge you, the consumer, any fees for its services. LendingTree receives its compensation from the Lenders for the goods, facilities and services actually provided by LendingTree. LendingTree’s compensation for GetSmart’s services varies by product, but will never exceed $400 per loan request.

Federal Disclosures
Your loan request will be forwarded to up to four Lenders , who may make certain disclosures to you. These disclosures, which are required by the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and certain other federal and state laws, include details of your cost of credit; good faith estimates of your settlement costs; HUD mandated booklets "Guide to Settlement Costs" and/or "When your Home is on the Line"; notices concerning the possibility that your mortgage loan servicing may be transferred; and your right to a copy of any appraisal, if any, performed on your home. The Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant’s income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law is the Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580.

If your loan request is forwarded to a Lender that makes you an offer, you should receive from the Lender a good faith estimate required under RESPA and an initial disclosure statement required under the TILA, each within three business days from the date you submit an application with the Lender.

If the Lender denies your request for credit, and that action is based, in whole or in part, on any information contained in a consumer credit report, you have the right to obtain, within sixty days, a free copy of your consumer credit report from the credit reporting agency which compiles and maintains files on consumers on a nationwide basis. You also have the right to dispute the accuracy or completeness of any information in a consumer credit report furnished by the consumer credit reporting agency by contacting that agency directly.

LendingTree Loans will perform the following services in connection with your loan request: (1) make loan request forms available to you; (2) transmit your completed loan request to participating Lenders in our network; and (3) offer you access to general educational information concerning home financing including glossaries, articles and calculators.

An applicant, if married, may apply for a separate account.

GFE ADDENDUM

DISCLOSURE AND FEE ACKNOWLEDGMENT

I/we understand that as compensation for its services as a mortgage broker, LendingTree will receive a fee of up to $400 from the Lender upon the closing of my loan. The actual amount of LendingTree’s fee is disclosed on the Good Faith Estimate you will receive from the Lender after your loan application is submitted. This is the total compensation LendingTree will receive from the Lender for its services and is paid by the lender. The Lender includes the fee that the Lender pays to LendingTree in your interest rate, points, fees and terms of the loan. I/we acknowledge that this mortgage broker fee will be paid to LendingTree outside of closing and that there is no other mortgage broker fee agreement between us.

I understand that your services may include, but are not limited to, the following: (1) counseling on available mortgage products; (2) counseling on general mortgage qualification procedures and requirements; (3) counseling on my financial capabilities; (4) assistance in obtaining information required to complete the mortgage application; and (5) assistance in processing the loan application, and in meeting conditions of the loan commitment.

I hereby agree to engage you for the purpose of advising me about financing and to provide the services described above. This agreement will continue until the earlier of the declination of my loan request, the closing of my loan or my termination of your services.

I acknowledge that prior to paying any fees or completing any application, I was advised of the following: (1) your services are advisory and administrative in nature and you are not acting as my agent in performing these services; (2) you are not authorized to make mortgage loans or commitments; and (3) you cannot guarantee acceptance into any particular loan program or specific loan terms or conditions.

CLO Fee: I understand that, as compensation for your services, you will receive a computerized loan origination fee (CLO Fee) of up to $400 upon the transmission of your loan request to a Lender. I acknowledge that this fee will be paid to you by the Lender outside of closing. The compensation you will receive from the Lender for your services is included in the rate, points, fees and terms of the loan as quoted by the Lender in its commitment.

CLO Fee Acknowledgment: I acknowledge that this CLO Fee will be paid to you. I further acknowledge that there is no other fee agreement between us with respect to your transaction. If required by the Lender, I may have to pay a loan application fee and credit report fee. The Lender will determine the amount of this fee. The Lender’s policy, not yours, determines if the fee is refundable. If the fee is refundable, the Lender will tell me the conditions for obtaining a refund.

Prepayment Penalties: I understand that certain mortgage products impose a prepayment penalty on the borrower. The Lender will tell me the amount of or formula for calculating the prepayment penalty, if any, and the terms of the prepayment penalty, if any. This information will be provided to me as soon as it is known, but no later than the issuance of a commitment by the Lender.

Washington
If your loan request is forwarded to one or more participating Lenders you may receive from the Lenders a good faith estimate of settlement costs under RESPA and an initial disclosure statement required under the TILA.

The interest rate quoted in connection with the loan you select is subject to change without notice unless and until an interest rate lock-in agreement has been made between you and the Lender. LendingTree does not offer lock-in agreements and does not guarantee any rate of interest quoted by a participating Lender. If you enter a lock-in agreement with the Lender and are required to pay a lock-in fee, the terms and conditions under which the lock-in fee may be refunded, if any, will be set by the Lender.

We will not collect any fees from you in connection with your completion of a loan request. All fees will be collected by and payable to the Lender. If the Lender is licensed under the Mortgage Broker Practices Act, the fees paid by you for third-party provider services (such as an appraisal or credit report), may be held in a trust account and any moneys remaining after the payment to third-party providers will be refunded to you.

If you are unable to obtain a loan for any reason, the Lender, if licensed under the Mortgage Broker Practices Act, will, within five (5) days of a written request by you, give copies to you of any appraisal, title report, or credit report paid for by you, and transmit the original appraisal, title report, or credit report to any other mortgage broker or lender to whom you direct. Transmission of these reports includes the right to use these reports. You are also entitled to receive a copy of any appraisal paid for by you, pursuant to the federal Equal Credit Opportunity Act.

Washington state law against discrimination prohibits discrimination in credit transactions because of race, creed, color, national origin, sex or marital status. The Washington State Human Rights Commission administers compliance with this law.
