General. LendingTree, LLC is a Delaware limited liability company with its corporate headquarters in Charlotte, North Carolina. Any reference in this Licenses and Disclosures to "we" or "us" or similar words shall refer to LendingTree, LLC unless otherwise indicated, all such entities referred to as "LendingTree". Any reference in Licenses and Disclosures to "you" or "your" means the person(s) using the LendingTree Websites (as defined in the Terms of Use Agreement), and/or the good, facilities or services of LendingTree offered through alternative methods. LendingTree is a computerized loan originator for mortgage loans performing computerized loan origination services for lenders and provides other services for non-mortgage loans. LendingTree is not a lender, auto lessor or credit card issuer. LendingTree does not take applications, make loans or credit decisions in connection with loans, nor does LendingTree issue commitments or lock-in agreements. Except as otherwise provided below for your state, LendingTree is not an agent of you, any participating bank, lender, mortgage broker or loan broker (we refer to all of these as "Lenders" or "Lender") or any third-party provider ("Provider"). LendingTree's services are only administrative. You should rely on your own judgment in deciding which available product and Lender or Provider best suits your needs and financial means. You are under no obligation to use LendingTree to commence the matching and request process and LendingTree does not guarantee that completing a request will result in you being matched with a Lender or Provider, receiving an offer from a Lender or Provider, or receiving a loan or service from a Lender or Provider.
Fees. LendingTree does not charge you any fee for its services. LendingTree receives its compensation from the Lenders or Providers for the goods, facilities and services provided by LendingTree. LendingTree's compensation varies by product and service. Computerized loan origination fees paid by the Lender may be included in your rate, points or term and will be shown on your settlement statement. Although some state licensing laws treat fees paid in exchange for computerized loan origination services as mortgage broker fees or origination fees, this is not the case under federal law. See the Terms of Use Agreement for details.
Credit. Any loan request you submit is NOT an application for credit. Rather, it is a request to be matched with Lenders to receive conditional loan offers from Lenders. You may have to complete an application with a Lender before they will extend an unconditional loan offer. A Lender you select may require you to pay an application or other fee to cover the costs of an appraisal, credit report or other items. The Lender will determine the amount of any such fee and should provide information to you regarding the refundability of any such fee.
Federal Disclosures. Any loan request will be forwarded to Lenders and these Lenders may make certain disclosures to you. These disclosures, which are required by the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), and certain other federal and state laws, include details of your cost of credit; good faith estimates of your settlement costs; HUD mandated booklets "Guide to Settlement Costs" and/or "When your Home is on the Line"; notices concerning the possibility that your mortgage loan servicing may be transferred; and your right to a copy of any appraisal, if any, performed on your home. The Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The agency that administers compliance with this law varies by Lender depending on its lending authority, may include the Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580.

Your loan request may be matched with Home Loan Center, Inc., which also does business under the names LendingTree Loans, Home Loan Center, Inc. dba LT Loans, Home Loan Center USA, Inc. and Loan Center, Inc., LT Loans or Online Home Center (depending on the state), a wholly owned subsidiary of LendingTree, LLC. If your loan request is forwarded to a Lender that makes you an offer, you should receive from the Lender a good faith estimate required under RESPA and an initial disclosure statement required under the TILA, each within three business days from the date you submit an application with the Lender. If the Lender denies your request for credit and that action is based, in whole or in part, on any information contained in a consumer credit report, you have the right to obtain, within sixty days, a free copy of your consumer credit report from the credit reporting agency which compiles and maintains files on consumers on a nationwide basis. You also have the right to dispute the accuracy or completeness of any information in a consumer credit report furnished by the consumer credit reporting agency by contacting that agency directly.

DISCLOSURE AND FEE ACKNOWLEDGMENT
You understand that as compensation for its services, LendingTree may receive a matching fee for matching me with a Lender and a computerized loan origination fee from the Lender upon the closing of your loan. The actual amount of LendingTree’s fee should be disclosed on the Good Faith Estimate you will receive from the Lender after your loan application is submitted. This is the total compensation LendingTree will receive from the Lender for its services related to the closing of your loan and is paid by the Lender. You acknowledge that this fee will be paid to LendingTree outside of closing and that there is no other mortgage broker fee agreement between you and LendingTree.

1. You have the right to review any file maintained by any consumer credit reporting agency, as provided under the Federal Fair Credit Reporting Act, 15 USC Sec. 1682 through 1681t.

You have the right to review the above mention file at no charge if a request is made to the consumer credit reporting agency within thirty (30) days after receiving notice that credit has been denied. If credit was not denied, the approximate price to review such file is $14, as set by the credit reporting agency.
3. You have the right to dispute the completeness or accuracy of any item contained in your file which is maintained by a consumer credit reporting agency.
4. The following paragraphs describe LendingTree’s fees and services:
a. LendingTree is a computerized loan originator, licensed in Oklahoma as a Credit Services Organization. It is not a lender and does not make loans or credit decisions in connection with loans. LendingTree will perform the following services for you: (1) make loan request forms available to you; (2) transmit your completed loan request to participating Lenders in our network; (3) offer you access to general educational information concerning home financing including glossaries, articles and calculators; and (4) send you the initial loan offers from Lenders responding to your loan request. If your loan request is forwarded to our participating Lenders, you will receive from the Lenders a good faith estimate of the settlement costs in connection with your loan in accordance with applicable law.
b. LendingTree does not charge you, the consumer, a fee to use our services. LendingTree is paid by its participating Lenders for the goods, facilities and services provided.
c. If your loan request is forwarded to our participating Lenders, you may be required by the Lender you select to pay an application fee to cover the costs of an appraisal, credit report or other items. The amount of the fee will be determined by the Lender. The documentation you receive will include information on the refundability of any fees paid.
d. LendingTree does not endorse, recommend or favor the products of any participating Lender. LendingTree is not an agent of you or any participating Lender. LendingTree's services are administrative and consultative only. You should rely on your own judgment in deciding which available loan product best suits your needs and financial means. You are under no obligation to use LendingTree to commence the financing process, and LendingTree, does not guarantee that completing a loan request will result in your receiving a loan from one of our participating Lenders.
e. You have the right to proceed against the bond that LendingTree is required to maintain. The name and address of the surety bond company that issued the bond is Aon Risk Services, 199 Water Street, 11th floor, New York, NY 10038.
Your submission of a loan request will serve as acknowledgement of your receipt of the above Information Statement.
Agreement
This agreement is made between you, the Buyer and LendingTree, LLC (“LendingTree”). This agreement is dated the date of your loan request to LendingTree. By submitting the loan request, you agree to the terms of this agreement.

The amount of the fee will be determined by the Lender. The documentation you receive will include information on the refundability of any fees paid.

This agreement is dated as of the date you submit your loan request.
NOTICE OF CANCELLATION
You may cancel this contract, without any penalty or obligation, within five (5) days from the date the contract is signed.
If you cancel any payment made by you under this contract, it will be returned within ten (10) days following receipt by the seller of your cancellation notice.
To cancel this contract, mail or deliver a signed dated copy of this cancellation notice, or any other written notice to LendingTree, LLC, the operator of this website at 11115 Rushmore Dr., Charlotte, NC 28277 not later than midnight on the day five (5) days after the date you submit the loan request.

Variable Interest Rate Disclosure
On residential mortgage loans of $50,000 or less, if the Lender offers to give you a mortgage with a variable interest rate, you are entitled by law to also be offered a mortgage with an interest rate that will not change. By law, this fixed interest rate mortgage must be offered to you at reasonably competitive terms and rate. On variable interest loans, the Lender will explain to you how the interest rate can change in the future, the effect of changes in the index on the rate and term, and an explanation of the index.

For South Carolina residents, LendingTree is acting as your agent in providing services. In providing those services LendingTree will provide you with the utmost care, honesty and loyalty in the transaction, including full disclosure of all material facts. LendingTree agrees to provide the following services to you:
Based on the information you provide to LendingTree and that LendingTree may receive from credit bureaus if authorized by you, LendingTree will provide you with multiple conditional loan offers through its network of nonaffiliated U.S. based banks, thrifts, mortgage brokers, mortgage bankers and finance companies (“Lenders”). To determine which Lenders may be matched with you, Lenders provide to us criteria about the type of loan (for example, loan amount; whether purchase, refinance, or equity loan) and the type of loan customer (for example, state of residence or creditworthiness) in which the Lender is interested. LendingTree will provide your information to up to five Lenders whose criteria match your profile. If fewer than five Lenders match your profile, you will receive conditional loan offers from fewer than five Lenders. If more than five Lenders match your profile, LendingTree will match you with five Lenders with a preference for those Lenders that have the highest customer satisfaction scores and the best record of making loans to previous LendingTree customers. If you are requesting a home equity loan or home equity line of credit, we may match you with up to four Lenders based on the above criteria as well as LendingTree Loans.
If offered to you, you can also authorize LendingTree to simultaneously submit a loan request to its GetSmart network if LendingTree cannot match you with five Lenders who make you conditional loan offers. LendingTree will attempt to match you with Lenders that can make conditional loan offers first then use its GetSmart network.
LendingTree is a computerized loan originator. It is not a lender and does not make loans or credit decisions in connection with loans. LendingTree does not endorse, recommend or favor the products of any Lender. LendingTree is not an agent of any Lender. You should rely on your own judgment in deciding which available loan product best suits your needs and financial means. You are under no obligation to use LendingTree to commence the financing process and LendingTree does not guarantee that completing a loan request will result in your receiving a loan from any Lender.
LendingTree does not charge you a fee to use our service. LendingTree is paid a Computerized Loan Origination match fee by the Lender between $4 and $56 and if you close a loan with the Lender, a Computerized Loan Origination closing fee of up to $1200 for the goods, facilities and services provided.
If your loan request is forwarded to a Lender, you may be required by the Lender you select to pay an application fee to cover the costs of an appraisal, credit report or other items. The amount of the fee will be determined by the Lender. The documentation you receive will include information on the refundability of any fees paid.
This Mortgage Broker Loan Agreement is dated as of the date you submit your loan request and is valid for ninety (90) days. For loan request information, including your name, the requested loan amount, lien priority and the date of your request, please see your Loan Information Page displayed prior to the submission of your loan request, which is incorporated herein by reference. For interest rates and fees applicable to your loan request, see the Lender responses to your request. LendingTree does not have any involvement in the setting of interest rates and fees on your request. Please print and retain a copy of this Mortgage Broker Loan Agreement and the Loan Information Page for your records.

Duties and Nature of Relationship
You, the applicant(s), have requested assistance in obtaining a residential mortgage loan. How LendingTree, LLC will be compensated
LendingTree, LLC will not charge you a fee to use its services. LendingTree, LLC receives its compensation from the Lender for the goods, facilities and services actually provided by LendingTree, LLC.
These fees are paid by the Lender and are not refundable under any conditions.
The estimated fee which LendingTree, LLC will receive at closing will be as shown on the good faith estimate which the Lender will provide to you within three (3) days of application with such Lender in accordance with the requirements of the Real Estate Settlement Procedures Act and its implementing regulations.

You are not relying on LendingTree to select a loan product for you.
LendingTree does not charge you a fee to use the LendingTree service.
LendingTree receives fees from our participating Lenders for transmitting your loan request to the Lenders and for closed loans that were originated through the LendingTree service.

You are not required to use LendingTree's computerized loan services to obtain a residential mortgage loan; and that the full range of loans available as offered by Lenders may not be listed on LendingTree's computerized loan services system, and different terms and conditions, including lower rates, may be available from others not listed on the system.
If your loan request is forwarded to one or more participating Lenders you may receive from the Lenders a good faith estimate of settlement costs under RESPA and an initial disclosure statement required under the TILA.
The interest rate quoted in connection with the loan you select is subject to change without notice unless and until an interest rate lock-in agreement has been made between you and the Lender. LendingTree does not offer lock-in agreements and does not guarantee any rate of interest quoted by a participating Lender. If you enter a lock-in agreement with the Lender and are required to pay a lock-in fee, the terms and conditions under which the lock-in fee may be refunded, if any, will be set by the Lender.
LendingTree will not collect any fees from you in connection with your completion of a loan request. All fees will be collected from and payable by the Lender. If the Lender is licensed under the Mortgage Broker Practices Act, the fees paid by you for third-party provider services (such as an appraisal or credit report), may be held in a trust account and any moneys remaining after the payment to third-party providers will be refunded to you.
If you are unable to obtain a loan for any reason, the Lender, if licensed under the Mortgage Broker Practices Act, will, within five (5) days of a written request by you, give copies to you of any appraisal, title report, or credit report paid for by you, and transmit the original appraisal, title report, or credit report to any other mortgage broker or lender to whom you direct. Transmission of these reports includes the right to use these reports. You are also entitled to receive a copy of any appraisal paid for by you, pursuant to the federal Equal Credit Opportunity Act.
Washington state law against discrimination prohibits discrimination in credit transactions because of race, creed, color, national origin, sex or marital status. The Washington State Human Rights Commission administers compliance with this law.

LendingTree does not distribute the products of all lenders in the market and cannot guarantee the lowest price or best terms available in the market.
LendingTree receives fees from participating Lenders and may be paid services, goods or facilities performed or provided by us to the Lender.
